These Software License & Terms govern installation and use of Pitmark Racing Tools (“PRT”), provided by Pitmark Racing Co. By installing, launching, accessing, or using PRT, you agree to these terms.
1. License
Subject to these terms and any applicable paid or early-access entitlement, Pitmark grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use PRT for its intended purpose. PRT is licensed, not sold.
2. Ownership
Pitmark retains all right, title, and interest in PRT, including its software, interface, overlays, documentation, branding, algorithms, configuration, and original content, excluding third-party components and trademarks owned by others.
3. Restrictions
Except where applicable law expressly provides a non-waivable right, you may not sell, sublicense, rent, lease, redistribute, share access credentials, circumvent license or security controls, reverse engineer or extract source code, use private APIs or proprietary materials to build a competing commercial system, introduce malicious code, exploit vulnerabilities, automate abusive access, or falsely represent affiliation with Pitmark.
4. Accounts and entitlements
Some functionality depends on a valid account, license, subscription, tester entitlement, or other authorization. Access may be suspended or revoked for fraud, chargeback abuse, credential sharing, security threats, material violations of these terms, or the end of an applicable test or subscription program.
5. Telemetry and diagnostics
PRT may process reasonable technical, diagnostic, performance, session, configuration, crash, and feature-usage information needed to provide, secure, test, support, and improve the software. See the PRT Privacy Notice for more information.
6. Third-party compatibility
PRT is an independent third-party tool designed to work with supported racing-simulation environments. Unless expressly stated in writing, Pitmark is not affiliated with, endorsed by, or sponsored by the developers, publishers, sanctioning bodies, manufacturers, tracks, leagues, or other third-party rights holders referenced in PRT. Third-party trademarks belong to their respective owners.
Compatibility may change when a third-party game, API, operating system, hardware device, graphics driver, or platform changes. Pitmark does not guarantee perpetual compatibility.
7. Simulation and safety disclaimer
PRT is intended for simulation and informational use. Overlay information, spotter messages, telemetry, predictions, coaching, incident information, flags, positions, maps, and other outputs may be delayed, incomplete, inaccurate, unavailable, or affected by third-party data. PRT must not be relied on for real-world vehicle operation, emergency response, safety-critical decisions, wagering, or any purpose where an inaccurate output could cause injury, property damage, or substantial loss.
8. Updates and early-access features
Pitmark may release updates, patches, hotfixes, feature additions, feature removals, entitlement changes, or compatibility changes. Some updates may be required to continue using PRT. Beta, preview, experimental, test, development, and early-access functionality may contain defects, crashes, inaccurate outputs, data loss, performance issues, or material changes.
9. Feedback
If you voluntarily provide bug reports, suggestions, ideas, recordings, screenshots, logs, test results, or other feedback about PRT, you grant Pitmark a perpetual, worldwide, royalty-free right to use, reproduce, modify, analyze, and incorporate that feedback into Pitmark products and operations without payment or attribution, without transferring ownership of unrelated material you own.
10. Suspension and termination
You may stop using PRT at any time. Pitmark may suspend or terminate access where reasonably necessary to protect users or systems, address fraud or abuse, enforce these terms, comply with law, or administer an ended test or entitlement.
11. Warranty disclaimer
To the maximum extent permitted by law, PRT is provided “as is” and “as available,” without warranties that it will be uninterrupted, error-free, compatible with all systems, or accurate in every circumstance. Non-waivable consumer rights remain unaffected.
12. Limitation of liability
To the maximum extent permitted by law, Pitmark will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from PRT. For a claim related to paid PRT access, Pitmark’s aggregate liability will not exceed the amount actually paid to Pitmark for the applicable PRT service reasonably connected to the claim, except where law prohibits such limitation.
13. Changes
These terms may be updated as PRT evolves. Material changes will be communicated reasonably and reflected by a new effective date.
